Terms & Conditions of Sale

Last updated:

These Terms & Conditions of Sale apply to goods supplied by Wallan Fencing and Timber Supply. They should be read with our Returns & Refunds Policy and apply to quotations, orders, collections and deliveries, subject to Australian Consumer Law.

Payment and ownership of goods

Payment must be made in accordance with the payment terms stated on the relevant quotation, invoice or approved account agreement.

Goods remain the property of Wallan Fencing and Timber Supply until all amounts owing for those goods have been paid in full. To the extent permitted by law, we may recover unpaid goods where payment has not been received.

Prices and quotations

Unless otherwise stated, prices are in Australian dollars and include GST where applicable. Prices, freight charges and other fees are subject to the quotation or invoice issued for your order.

Quotations, availability and lead times are subject to change before acceptance. Please confirm product sizes, quantities, specifications, colours and suitability before ordering.

Returns, restocking and non-returnable products

Returns must be approved by Wallan Fencing and Timber Supply before goods are returned. A 10% restocking fee applies to all approved change-of-mind returns and will be deducted from any refund or credit.

We do not accept change-of-mind returns for Colorbond products. We may also be unable to accept returns for cut-to-length timber, custom-ordered, fabricated, drilled, welded, modified, specially mixed or tinted products, clearance goods, or goods that are no longer in saleable condition.

Nothing in these terms limits any consumer guarantee, right or remedy that cannot lawfully be excluded under Australian Consumer Law.

Concrete products

Concrete products may have reasonable variations in colour, texture, surface appearance and finish due to their materials and manufacturing process. Minor cosmetic variations that do not affect intended performance are not necessarily defects.

Please inspect concrete products before installation where reasonably possible and notify us promptly of suspected damage or defects.

Delivery

Delivery dates and times are estimates unless expressly agreed otherwise. You are responsible for providing accurate delivery information and ensuring the delivery location is safe, suitable and reasonably accessible for the delivery vehicle.

Before delivery, tell us about hazards or restrictions that may affect safe access, including overhead powerlines, underground services, soft ground, narrow access or low clearances.

Unloading and property access

Unless otherwise agreed, delivery includes unloading at a safe and reasonably accessible location selected by the driver. Any request to place goods in a particular position on private property is subject to safe access and the driver's discretion.

Where you request a vehicle, forklift, crane or other equipment to enter or operate on private property beyond the normal safe unloading point, you do so at your risk to the extent permitted by law. Our drivers may refuse access or unloading instructions they reasonably consider unsafe or unsuitable.

Collections

Customers collecting goods are responsible for ensuring their vehicle or trailer is suitable for the size, type and weight of the goods. We may refuse to load where staff reasonably believe loading would be unsafe or unlawful.

You are responsible for restraining and securing the load before leaving our premises.

Damaged, faulty or incorrect goods

Please inspect goods at delivery or collection where reasonably practicable. Report visible transport damage, incorrect quantities or incorrect products as soon as reasonably possible, preferably before goods are installed or altered.

Keep proof of purchase and, where possible, provide photos and details so we can assess the issue. Do not dispose of goods before we have had a reasonable opportunity to inspect them, unless we agree otherwise.

Installation and product suitability

Unless installation services are separately agreed in writing, Wallan Fencing and Timber Supply supplies materials only. Customers, builders and installers are responsible for correct installation, site measurements, product suitability, engineering requirements and compliance with applicable laws and regulations.

Where site-specific engineering or professional advice is required, obtain advice from an appropriately qualified professional.

Australian Consumer Law

These Terms & Conditions are subject to Australian Consumer Law and other applicable laws. Nothing in these terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
